http://coppolacomment.blogspot.co.uk/20 ... reece.html

But embedded in the text (p.4) is this admission that the programme was ALREADY off track before Syriza came to power:

The 2014 primary fiscal balance fell short of the program target by 1.5 percent of GDP.

That is a considerable shortfall. And this was on top of the slippage identified in the previous programme review:

Debt/GDP was projected to fall from 175 percent of GDP at end–2013 to about 128 percent of GDP in 2020 and further to 117 percent of GDP in 2022. These were above the thresholds agreed to in November 2012, of debt coming down to 124 percent of GDP in 2020 and to “substantially below” 110 percent of GDP in 2022.

In fact these charts from the IMF's report show that the programme had failed to meet targets from the start:
In 2013 the growth target was missed by a mile on the downside and the primary balance was also slightly below target. This programme has NEVER met its targets. Nor did the previous one.
(...)
The message from the IMF to the EU negotiators is clear: "We've had enough of this. Restructure this debt NOW or we are out."

According to eurozone officials, EU legal scholars have been combing through the treaties to find provisions that would allow for Grexit – not because it is something they’re pushing for, but rather because they’re worried the country could be soon entering a legal limbo that could prevent it from getting the financial aid it desperately needs.

If Greece begins printing its own money – which could happen in a matter of weeks if the European Central Bank decides to cut off emergency loans to Greek financial institutions – it may no longer be eligible for aid from the eurozone’s €500bn rescue fund, since it is using a different currency.

But because Greece would still be legally part of the eurozone, it wouldn’t be eligible for the aid scheme reserved for non-EU countries, known as a “balance of payments assistance” programme. Hungary, Romania and pre-euro Latvia all received so-called “BPA” programmes during the crisis.

The traditional assumption is that because there is no explicit way to leave the eurozone, the only clause that comes into play is Article 50 of the Treaty on European Union, which allows for withdrawal from the entire EU. This would require Greece to request a departure, however, which is unlikely, and while there are an increasing number of leaders willing to let Greece leave the eurozone, none want it to leave the EU.

Officials say lawyers are instead looking at Article 7, which was adopted for a very different reason: In the wake of the Austrian government’s decision to include the far-right Freedom Party of nationalist Jörg Haider in a coalition, EU leaders wanted a way to punish countries that did not live up to European values.

Article 7 says the European Commission can propose a country is violating European values, and if all member states agree, the EU can “suspend certain of the rights deriving from the application of the Treaties to the Member State in question”.

Is printing your own money while in the eurozone a clear violation of European values? That might be a tough hurdle to climb. But Article 7 would also allow for suspension from the eurozone rather than complete expulsion, and it would not need Greece’s consent to apply the provision.

The more likely measure, officials say, is a sort of catch-all “flexibility clause” included in the Treaty of the Functioning of the European Union. The provision, Article 352, basically says: if you need to do something that helps the EU on its way, but it’s not in the treaty already, go ahead – but you need to have unanimous consent to do so. Here’s the actual language of the article:

If action by the Union should prove necessary, within the framework of the policies defined in the Treaties, to attain one of the objectives set out in the Treaties, and the Treaties have not provided the necessary powers, the Council, acting unanimously on a proposal from the Commission and after obtaining the consent of the European Parliament, shall adopt the appropriate measures. Where the measures in question are adopted by the Council in accordance with a special legislative procedure, it shall also act unanimously on a proposal from the Commission and after obtaining the consent of the European Parliament.

The unanimity part of the clause means that Greece itself would have to agree to Grexit, which right now seems highly unlikely. But who knows. If it means bailout relief may finally come, it could be the solution.

GREEK UPDATE: AFTER VAROUFAKIS
· Grexit is our base case. One week ago, we raised the probability for Grexit to 55%. The referendum result has clearly not reduced that probability, to put it very mildly.

· As discussed a week ago, almost the only chance to keep Greece in the euro is serious political change that must happen fast, for instance a formal or informal coalition of pro-European parts of Syriza with the pro-European opposition parties. Trust has been shattered too badly for the current government to really clinch a deal with Europe.

· The clear referendum result of 61% "no" has, on its own, made it less rather than more likely that we may get such serious political change.

· But two resignations leave a chance that there may be still a minimum of political change in Athens: Varoufakis and Samaras.

· Tsipras has booted out his finance minister Varoufakis, who arguably caused capital flight of tens of billions of euros through his confrontational style that made agreement with creditors so much more difficult. That is a positive signal. Eurogroup finance ministers may finally have serious discussions about the actual issues again instead of having to deal with Varoufakis. But as Varoufakis was no longer leading the negotiations since April, this may be more symbolic than a change of substance.

· Former prime minister Samaras has resigned as head of the major opposition party New Democracy. That could make it much easier for the three pro-European opposition parties to join forces.

· These two changes leave some chance that Greece may get an informal or formal "national unity" coalition to strike a deal with creditors and get it through parliament. But at this stage, that is just an outside chance. Greece is in limbo until further notice, sliding towards Grexit unless Athens changes course.

THREE MAJOR OBSTACLES TO A DEAL AFTER A “NO”
Politics: After a “no”, negotiating a new bailout would be me much more difficult than it would have been to simply extend the old bailout. The European money will have to come from the permanent bailout fund, the European Stability Mechanism ESM, and no longer from the old temporary EFSF fund. Before formal negotiations could even start, the German Bundestag would have to explicitly authorise German finance minister to conduct such negotiations. Some other countries have similar procedures which cost time and pose serious political hurdles.

A bigger fiscal hole in Athens: With the expiry of the old bailout, with capital flight of €60bn within six months and deposit outflows of about €40bn and with the mere fear sparked by the referendum, the outlook for the Greek economy and its banks has worsened significantly. A new bailout will require a new assessment of financing needs. This will almost certainly reveal a much bigger fiscal hole than had been the basis for negotiations so far. A new deal will thus require significantly more Greek reforms as well as more money from creditors. For both sides, that creates major hurdles.

Lack of trust. The major reason for the Greek descent into a deepening recession and financial chaos after the rebound of 2014 is the current government. By promising the impossible, shattering trust and spreading fear, it has pushed the Greek economy into a downward spiral. Trust matters. It may take serious political change in Athens to restore enough trust so that capital could flow back and the potential Greek economic and financial accident be averted. For such serious change, the ouster of Varoufakis is no more than a small start.

The referendum result has emboldened the hardliners within Syriza and made it more difficult and expensive for Europe and the IMF to strike a deal with Athens.

The key consultations within Europe are immediately ahead with the meeting between Merkel and Hollande in Paris at 17:30h today in Paris, followed by a Eurogroup finance minister meeting and a summit meeting tomorrow. Whether or not Europe should offer discussions about how to smooth a Grexit rather than on how to perhaps still keep Greece in the euro may be contentious, with France probably inclined to take a softer line. As a result, Europe may still make a final offer to Tsipras to stay in the euro and avoid full-scale default. But if so, such an offer might be slightly different in details but not softer than the deal which Tsipras rejected. We look for the ECB to play a holding game today, not cutting ELAs but possibly telling European leaders that without a clear political signal, ELAs would have to be cut soon.
